1. Scope of application and modification of the conditions of sale
The present general conditions of sale apply to all orders placed on the Montecarlo-sports.com site.
Montecarlo-sports.com reserves the right to adapt or modify these general conditions of sale at any time. In the event of a modification, the general conditions of sale in force on the day of the order will be applied to each order.

2. Our offer
All offers of products, services and delivery terms, at prices quoted in euros, are valid while stocks last.
For orders from the European Union, the Monegasque VAT rate applies.
Shipping charges will apply and will be indicated to you when you choose your delivery method.
For orders from countries outside the European Union, the products will be invoiced tax-free and you will have to pay shipping costs calculated according to the country of destination and the weight of the package.
Upon receipt of the package, you will have to pay customs duties and local VAT according to the country of destination. The amount of shipping costs will be indicated when you choose the delivery method.

A description with the essential product features can be found on every item we sell. However, there may be some minor variations, which is why we recommend that you contact our customer service department if in doubt.
Our teams do their best to give a faithful image of the products offered for sale with images or photographs used for their presentation. However, variations may appear due to technical limitations, color rendering or customer equipment (Internet browser, screen used). Montecarlo-sports.com therefore recommends the customer to refer to the description of the products on the site to know their essential characteristics.
Except in the case of warranty, any transaction between Montecarlo-sports.com and its customers that is not contested within 7 days of delivery cannot give rise to a claim.
3. Validation of orders and electronic signature
The customer acknowledges that he is informed that his commitment does not require a handwritten or electronic signature and that the acceptance of these general conditions of sale and the order of the basket is implemented by the click mechanism.
4. Orders
Orders can only be placed on the site if you are clearly identified or by entering your login and password which are strictly personal, or by creating an account on Montecarlo-sports.com if you are not yet registered. Any order implies acceptance of the prices and description of products available for sale. The contract of sale is formed when the confirmation of your order is issued.
As soon as your order is validated, it will be transmitted to our logistics services for processing. Within an hour of placing your order, you will receive an automatic first email confirming receipt.

Standard products such as SIXS products are generally shipped within 10 working days after receipt of payment.
Custom products are shipped within 20 working days of receipt of payment and are shipped with Colissimo or Chronopost with tracking and delivery with signature.
5. Prices
Prices are indicated in euros and take into account the Monegasque VAT in force.
6. Payment and security
6.1 BY CREDIT CARD
Payment is made on our secure payment interface. This means that no bank information can be stolen by third parties.
Payment by credit card is perfectly safe, Montecarlo-sports.com certifies that it is not in possession of any banking information entered during the ordering process.
All bank details are transmitted directly in real time to our banking partner LCL (Le Crédit Lyonnais). The debiting of your account is done at the time of shipment of your order, LCL provides us with a pre-authorization of debit, valid for 6 days.
Security of payments: Your credit card information is encrypted using the TLS (Transport Layer Security) protocol and is never transmitted unencrypted over the network. The payment is made directly to the bank. Montecarlo-sports.com has no access to these data and does not store them on its servers. This is why credit card details are requested for each new transaction on our site.
6.2 BY PAYPAL
We no longer accept Paypal as a means of payment.
6.3 BY CHEQUE
In case of payment by check, your order is held for 15 days. Beyond this period, without the receipt of your check, it will be canceled. The order will be processed upon receipt of your check and after validation. The shipping time announced may vary depending on the time of receipt of your payment.
6.4 BY BANK TRANSFER

6.5 RETENTION OF TITLE
The products remain the property of Montecarlo-sports.com until full payment of the order is received by the customer. From the moment of shipment, the risks of the goods in transit are transferred to the customer.
6.6 DEFAULT OF PAYMENT
Montecarlo-sports.com reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in whole or in part for a previous order or with whom a payment dispute is pending.
6.7 ANTI-FRAUD CONTROL
The security of your orders on Montecarlo-sports.com is a fundamental concern for us. That is why orders are checked before being sent.
As part of this control and in order to combat fraud and usurpation of means of payment on the Internet, Monte Carlo-sports.com, may ask the customer to provide proof of identity and residence. Depending on the date of receipt, the time of shipment of the order may be delayed.

7. Terms and conditions of delivery
Conditions of delivery:
Montecarlo-sports.com undertakes to respect as much as possible the date of shipment that is given to you as an indication in the product sheet, in the cart, in the summary of your order and on the order confirmation email. A delivery date will also be indicated when you have chosen the delivery method that suits you best.
Deliveries outside Monaco:
For deliveries outside of Monaco, the delivery costs depend on the destination and will be communicated to you when you place your order.
For transport reasons, some products cannot be shipped to certain countries and Corsica.
In this case, the information will be given to you when processing your order.
Taxes applied to your orders:
For deliveries within the European Union, Monegasque VAT is applied to your order and you will not be able to recover VAT in your own country.
For orders outside the European Union, the products will be invoiced without tax and you will have to pay shipping costs calculated according to the country of destination and the weight of the package. Upon receipt of the package, you will also have to pay customs duties, VAT and other local taxes, depending on the country of destination.
The amount of shipping costs (excluding duties and taxes applicable in your country) will be indicated to you when you choose the delivery method. Regarding shipments outside the EU, we draw your attention to 2 points:
all duties and taxes are calculated by the customs services on the amount of the order including transport.
If you choose an "express" carrier, they will invoice you additional fixed costs of dossier (generally between 20 and 30 €), as they perform, by delegation of the customs, the calculation and collection of duties and taxes, which allows you to save time with the delivery.

No compensation can be claimed if an item cannot be delivered: whether as a result of an unforeseen stop in production, strikes, accidents, natural disasters, inability to supply or any other cause beyond our control.
Delivery of orders is impossible on public holidays.
The withdrawal period is 14 days for non-professionals. The return is the responsibility of the customer.
8. Right of withdrawal
If the size of a product ordered on Montecarlo-sports.com does not fit, or if you simply realize that the product does not meet your expectations, you have the option to return it to us for exchange, credit or refund.
The withdrawal period does not apply to specific orders placed by the Customer and manufactured for him, such as an order for a customized or specially packaged product available only at the specific request of the manufacturer or custom-made at the request of the Customer.
Likewise, this withdrawal period does not apply to intimate apparel or similar items such as shorts, bras and the like.
9. Conditions of return
The right of withdrawal is only available to consumer customers, and does not apply to commercial or professional customers.
9.1 The item must be returned and be delivered to Monte Carlo-Sports.com within 14 days of receipt of the product.
If it is a gift, please inform customer service.
9.2 The item must be returned in the same box in which it was sent or in an identical box (reinforced and of the same size) if the first one has been damaged.
9.3 The product must not have been worn but only tried on. All labels must be present and attached to the product for the exchange to be accepted. The product must be in perfect condition and well folded in the original packaging to avoid wrinkles. Do not forget to put the plastic packaging around the product to protect it.
9.4 Of course the item must have been purchased on Montecarlo-Sports.com. You can exchange it for another, opt for a credit note equivalent to the value of the product or get a refund. The process will be explained to you step by step, but be sure to print the summary to attach to the package.
Attention: The After-Sales Service reserves the right to refuse the return if one of the conditions is not met, the package will then be directly returned to you.
You will be responsible for the shipping costs of the replacement product.
Shipping costs will not be refunded. For an exchange of the product we will have to charge you again the shipping costs.
In case of a refund the shipping costs will not be refunded.
10. Product warranty
10.1 Commercial warranty
The products sold are covered by a commercial warranty granted directly by the manufacturer to ensure their conformity and to ensure the refund of the purchase price, replacement or repair of the goods. It does not cover defects caused by abnormal or faulty use or resulting from a cause not related to the intrinsic qualities of the products; the warranty does not cover defects or deterioration resulting from use other than that for which they were designed.

Should any of the clauses of this contract be null and void due to a change in legislation, regulation or a court decision, this would in no way affect the validity of and compliance with these general conditions of sale.
13. Liability and Dispute Resolution
Montecarlo-sports.com cannot be held responsible for inconveniences and damages related to the use of the Internet network such as an interruption of service, the presence of computer viruses or external intrusions or more generally any case qualified as force majeure by the courts.
In the event of a dispute, an amicable solution will be sought before any legal action. A recovery procedure will be initiated by us. This procedure will result in the billing of collection fees of a fixed amount of 50 € per order. Failing this, any legal action will be brought before the court of Monaco.
These conditions are subject to Monegasque law.

According to the law, any reproduction, even partial, of the elements of the site Montecarlo-sports.com requires a prior written agreement of the company Monatech.
